The Gluci-Chek Application (hereafter the “Gluci-Chek App”) is made freely available to users (hereafter "User") by Roche Diagnostics France. It is available in French and English. The fact to download it implies that you agree to the free provision of the Application, and rules related to withdrawal right are not applicable, being noted however that the Application may in any case be uninstalled at any time by the User. By making it available, Roche agrees to provide such application.
The Terms and Conditions of Use set out below are available in French and English. Roche Diagnostics France may change the Terms and Conditions of Use at any time without prior notice, being noted that any modification will be subject to a prior agreement of the User (especially regarding the duration of its use, its characteristics or price). User can access the Terms and Conditions of Use at any time, as accepted in the Application, by visiting the "Terms of Use" section of the Gluci-Chek App.
The use of Gluci-Chek App implies acceptance by User of all of these provisions.
The consent of the User to these terms is requested upon installation of the Application. Should the User refuse, he will not be in a position to use the Application.
The User commits to review and understand the good practices for use of the Gluci-Chek Application by reading carefully these terms of use.
The Gluci-Chek App is to be used to provide information to the general public and, specifically, for patients with diabetes under insulin-treatment.
It comprises:
A customizable food base with associated visuals showing straight and compound foods, the amount of carbohydrates for each of these foods, besides additional information (energy, protein, fat...);
A calendar of events to monitor and record the amounts of carbohydrates, insulin doses and meals sugar contents;
Graphs permitting to monitor the evolution of carbohydrate intakes and check whether sugar objectives have been met;
Graphs permitting to monitor the evolution of carbohydrate intakes and check whether sugar objectives have been met;
A function to automatically transfer glycaemia data from the Accu-Chek® Guide or Accu-Chek® Mobile meters or insulin doses from Mallya devices to the Gluci-Chek Application via the Bluetooth® connection;
Hence, with the Gluci-Chek App, the User can:
View all the foods that make up a meal, complete with total carbohydrate intake as well as fat levels;
Record carbohydrate counts, insulin doses and meals, while putting each entry in context by means of tags and personal notes, thereby facilitating follow up, a posteriori analysis and treatment ultimately;
Visualize the glycaemia measures realized with its meter or insulin doses transferred via the Mallya device in the Gluci-Chek Application..
The functionalities made available to the User have been designed to meet the above-mentioned objectives. They enable the User to record information and use the Gluci-Chek App as a carbohydrates self-monitoring logbook.
The User is informed of the following technical limitations (not exhaustive); visualisation in millimoles is not supported by the Application therefore values will be translated into milligrams by the meter; HIs and LOs control are not displayed in graph and stats ; BG and insulin values entered by the User cannot exceed certain minimum and maximum values.
The information the Gluci-Chek App may contain or transmit is not meant to provide a diagnostic or medical advice and is not intended in any way to replace the patient / healthcare professional relationship or replace a medical consultation. The information found in the Gluci-Chek App does not constitute a consultation or a treatment recommendation and should not be considered as such.
With the Gluci-Chek App, Roche Diagnostics France does not claim it can provide customized personal medical advice or recommendation, or draw conclusions from the results obtained from the data entered by the User.
The Gluci-Chek App must be used in accordance with its intended purpose and with these Terms and Conditions of Use.
The Gluci-Chek App is used under the sole User’s responsibility, control and management. The User is aware the data recorded in their equipment/mobile phone, via the Gluci-Chek App, could be accessed by anyone having access to the aforementioned devices. The User commits to implement all adequate measures to protect access to these devices or to the Application by using the appropriate functionalities proposed by its smartphone.
Roche Diagnostics France has no control over how the Gluci-Chek App is used by the User or a third party or how the information provided is interpreted.
Roche Diagnostics France is not responsible for the topicality, quality, completeness and accuracy of data entered by the User. In no event is Roche Diagnostics France able to appreciate the User's state of health or situation. The User is solely responsible for any decision made or action implemented based on the information entered in the Gluci-Chek App and for the results. The Gluci-Chek App does not conduct any control of the adequacy or consistency of the data entered by the User.
The User of the Gluci-Chek App agrees to use it in compliance with the applicable legislation in France and applicable regulations in the relevant country if the User is not a French citizen or resident, including legislation on the protection of intellectual property rights. It is the same with regard to (but not limited to) the rules of public order, respect for the privacy of individuals or in case of computer fraud.
The Gluci-Chek App User is aware of the constraints and limitations of mobile Internet and telecommunications networks, and therefore commits to:
Protect the equipment/mobile device against all forms of viruses, intrusion attempts, access and/or unauthorized use (s) by third parties;
Ensure the conditions of installation, operation and maintenance of the equipment/mobile device necessary for the proper functioning of the Gluci-Chek App.
The User acknowledges that access to the hypertext links leading to the Roche Diagnostics France internet sites offered as the case may be in the Gluci-Chek App (hereafter the “Websites”) is conditioned to the conditions of coverage, saturation and availability of the telephone network they have selected. Besides, the User acknowledges the good working of the Gluci-Chek App is conditioned to their device/mobile phone operating system.
More generally, Roche Diagnostics France will in no way be held responsible for any direct and indirect damage whatsoever arising from use of the Gluci-Chek App in any way and under any circumstances, which would not result from a breach by Roche Diagnostics France of its obligations as specifically listed in these terms.
Summary of data flow :
Usage data produced by the Application is processed by the Firebase tool for statistical purposes;
Crash data is processed by the Sentry tool for correction purposes;
When the User chooses to connect the Accu-Chek® Guide or Accu-Chek® Mobile meter with the Gluci-Chek Application via Bluetooth®, glycaemia data will be transferred as follows:
The synchronization of data will be one-way: only from the Accu-Chek® glucometers to Gluci-Chek and not the opposite;
The synchronization of historical data will go up to the last 720 (Accu-Chek® Guide) or 500 (Accu-Chek® Mobile) blood glucose measures;
Data sharing is defined to work with iOS 13 and above and Android 8 and above;
The synchronized data coming from Accu-Chek® glucometers will be indicated as such in Gluci-Chek;
The data will automatically be shared from Accu-Chek® Guide to Gluci-Chek by default each time new data will be detected on the glucometer thanks to a timestamp;
On the other hand, the data will not be automatically shared from Accu-Chek® Mobile to Gluci-Chek and the user will have to manually click on the power button of the wireless adapter;
The patient cannot delete or edit one single entry coming from an Accu-Chek® glucometer;
If the patient wants to unpair Accu-Chek® glucometers, no new data will be shared but old data will remain in the Application unless the User deletes the Application from his smartphone.
When the User chooses to connect the Mallya device with the Gluci-Chek Application via Bluetooth®, insulin doses will be transferred as follows:
The synchronization of data will be one-way: only from Mallya device to Gluci-Chek and not the opposite;
The synchronization of historical data will go up to the last 100 insulin doses (in accordance with the limitations of the Mallya device);
Data sharing is defined to work with iOS 13 and above and Android 8 and above;
The synchronized data coming from Mallya device will be indicated as such in Gluci-Chek;
The data will automatically be shared from Mallya device by default each time new data will be detected on Mallya device thanks to a timestamp;
In order to synchronize data, User will be asked to select the type of insulin of the insulin pen connected to Mallya device, from the compatible list. It is the User's responsibility to ensure that a compatible insulin pen is connected to Mallya device;
In the event where Mallya device does not detect the exact dose of the injection Users will be required to manually insert the data;
In case of injections below a certain unit amount, Mallya device categorizes automatically as priming or injection in accordance with the rules specified in the Mallya documentation. Users shall always verify in the logbook that priming and injections are recorded as such;
If the patient wants to unpair Mallya, no new data will be synchronised to Gluci-Chek. However, old data will remain in the Application unless the User deletes the Application from his smartphone.
If the patient unpairs Mallya device, a full reset of the device will be needed to pair it again which implies the deletion of all values present in Mallya device. All data not synchronized before reset will be lost.
The user can still use the Gluci-Chek application during the synchronization with the meter, or the Mallya device; synchronization will only happen in the foreground but not in the background or if the User uses other apps or closes the App. Absent a connection, User will still be able to use Gluci-Chek locally on its smartphone and data will be saved only locally on the smartphone itself. The industrial property or copyright rules are the current French legislation applicable to the Gluci-Chek App.
Google Play and App Store badges are used to promote the Application. Google Play and the Google Play logo are trademarks owned by Google LLC. Apple, App Store and the Apple logo are trademarks owned by Apple Inc. These trademarks have been registered in the United States and other countries.
All brands listed in the Gluci-Chek App are owned directly by or licensed to a Roche Group company or one of its partners.
All components in the Gluci-Chek App (text, data, databases, graphic designs, names, brands, animation, photos, layouts, logos, etc.) are covered by intellectual property rights. Roche Diagnostics France grants the User a non-exclusive, non-transferable, personal, limited right to access, use, view and copy the elements of the Gluci-Chek App. This right is granted for exclusively personal and non-commercial use and for the duration of the use of the Application. Any reproduction, transmission, distribution or other use of information or content of the Gluci-Chek App beyond the scope of the above-described purpose is strictly prohibited. Any request to use or reproduce information from the contents, for any purpose other than those stipulated in these Terms and Conditions of Use, must be submitted to Roche Diagnostics France in order to obtain prior written approval.
Compliance and hidden defects guarantees are not applicable to the provision of the Application for free. The Gluci-Chek App contains components and information which comply with applicable French legislation and includes food products available on French territory. Roche Diagnostics France is not responsible with regard to access to information that might not be compatible with the legislation, regulation or usage outside France.
The Gluci-Chek App is provided “as is” and without warranty of any kind.
Besides, Roche Diagnostics France does not warrant that:
The functionalities of the Gluci-Chek App will meet all the User's needs;
The Gluci-Chek App will work normally when installed or used in combination with other applications, software or other components installed or synchronized with the User’s equipment/mobile device;
The Gluci-Chek App will be free from error or malfunction.
Roche Diagnostics France cannot be held responsible for a malfunction of the Gluci-Chek App and from the resulting consequences.
Use of the Application is for an undefined period and may be interrupted at any time by either party. The User may uninstall at any time the Application which will terminate these terms for the future without notice.
Roche Diagnostics France reserves the right to modify the Gluci-Chek App at any time without prior notice, but is not obliged to provide updates.
In general, Roche Diagnostics France will do its best efforts to inform the User in advance if the availability of the Application were to end however for serious reasons it may also be decided to stop providing the Gluci-Chek App at any time without prior notice and this shall not entitle the beneficiary of the service to any compensation.
These terms may be transferred totally or partially by Roche Diagnostics France, at any time and to any person, by any means including assignment of the agreement or business transfer or control change, without prior agreement of the User unless such a transfer is likely to decrease the rights of such User.
These Terms and Conditions of Use of the Gluci-Chek App are subject to French law. In case of dispute, the parties will attempt to find an amicable settlement. Failing this, the dispute shall be submitted to the competent courts.
